2011 Election Watch: Ohio

reason.tv -"If you're going to take away liberty and property, there has to be some sort of due process involved," says Chris Littleton, the head of Ohioans for Healthcare Freedom and a Tea Party leader in the Buckeye state. "In this case, as citizens, we feel that those things are fundamentally inhibited and we want the Supreme Court to hear our case on this."


Littleton's group is pushing an upcoming ballot initiative that would amend the state constitution to prevent citizens' involuntary participation in any health-insurance system. The U.S. Supreme Court is widely expected to issue a ruling on the constituationality of what's known as the "individual mandate" in Obamacare and Littelton thinks passage of the Ohio Healthcare Freedom Amendment will give his state unique legal standing:

"This is citizen-initiated, which is very unique. If it passes, Ohio will be the only state that's done something like that."
While most challenges to the individual mandate revolve around the limits of Congress' commerce clause powers, Littleton believes the amendment will activate due process and 10th Amendment considerations.

Hopefully the amendment will pass. I also feel confident that the Supreme Court will strike down the individual mandate. Hoping that dismantles all of Obamacare.

You know what My vote is gonna be.

I'll take pleasure in voting in Ohio this election. Lot's of pro or anti-socialism stuff on ye olde ballot.

Interesting piece and based on his poll #'s of 55% looks like they could stave off Obamacare, either way of how the SC decision would go.

The polling suggested by Littleton shows much promise and would serve as a basis for the SC to weigh in favor of the people let alone the constitution.

Thank you my friend. One must always be wary when amending a State constitution but this is cut and dry in preempting a clearly socialist plan.

Yes, the polling caught my attention as well. Whats really important here is that it will clearly show that the people do in fact have "standing" in this issue, being they will have had to vote to amend their State Constitution to underline that point.
